“Ebrahim Raisi”, the President of Iran announced the resolution “Amendment of the Law on Organizations and Procedures of the Court of Administrative Justice”. According to the aforementioned resolution, the Administrative Court of Justice does not have the right to review the resolutions of the Supreme Council of Cyber Space in the field of this body’s jurisdiction.
By approving the law, the President increases the power of the Supreme Council of Cyberspace. According to this law, the Court of Administrative Justice can no longer invalidate the council’s approvals. The said law has been the subject of discussion by some parliamentarians and legal activists during the last one year. After making the necessary reforms, the Guardian Council finally approved this law on May 10, and it was promulgated by “Ebrahim Raisi” yesterday. The reaction of legal activists regarding the law to increase the power of the Supreme Council of Cyberspace
Based on this, the approvals of these two institutions regarding policy are outside the jurisdiction of the Court of Administrative Justice, and their other approvals are under the jurisdiction of the General Board of the Court of Administrative Justice to be similar to the decisions of other administrative authorities. This plan was already accompanied by conflicting reactions from parliamentarians and legal activists. “Mohammed Jaafar Naanakar” did not consider this resolution without problems, because in the event of the implementation of this law, extra-power councils have been established that have irrevocable resolutions. On the other hand, “Reza Ayazi” believes that the Islamic Council has turned an obvious unwritten matter into a law and has put an end to the disputes among jurists.
In the past days, the government handed over the responsibility of cyberspace security to the National Cyberspace Center. The National Center for Virtual Space is a government institution that was established in 2013 and is currently headed by “Mohammad Amin Aghamiri”.
